  • Asbestos - A naturally occurring substance, mined from rock and made up of tiny fibers, used extensively in thousands of building and insulation products.

     Asbestos fibers - The most common fibers found in processed asbestos are amosite, crocidolite and chrysotile.

    Asbestosis - A serious lung disease caused by inhaling asbestos fibers. The fibers tear the tissue of the wall, and the lung tissue scars, becoming stiff and preventing the lung from working as it is supposed to. Asbestosis is progressive (it gets worse over time) and can be fatal.

     

Since the early years of litigation, the asbestos companies have often defended themselves by arguing that smoking is the cause of the injury. This is because of the synergistic relationship between smoking and asbestos exposure: the risk of disease for workers who smoked and were exposed to asbestos is very much higher than for workers who did not smoke.

However, when sued, the tobacco companies mounted massive legal campaigns to avoid any liability in asbestos litigation. They abused court rules about civil discovery and made it prohibitively expensive for small plaintiffs' law firms to sue tobacco companies. As stated in an internal document prepared by R.J. Reynold's counsel, they won by making sure that the plaintiff's spent all of their money and financial resources.

Only very recently, especially because of the efforts of asbestos plaintiffs' attorneys, has the tobacco industry become more vulnerable. Efforts are now under way to make the tobacco industry responsible for their share of what was done to victims of asbestos disease.

Tobacco Smoking  vs. Asbestosis


Smoking tobacco has not been directly linked to the development of mesothelioma or asbestosis, but it is linked to lung cancer. There is also a synergistic relationship between smoking and exposure to asbestos, and the development of lung cancer.
Workers who were exposed to asbestos and who smoked or were exposed to second-hand smoke run a risk of getting lung cancer that is 50 to 90 times higher than that of the general population. According to the 1985 Surgeon General's report, The Health Consequences of Smoking: Cancer and Chronic Lung Disease in the Workplace, asbestos workers who smoked a pack or more a day are eighty-seven times more likely to die of lung cancer than the general nonsmoking public. This risk is eight times higher than other smokers and seventeen times higher than asbestos workers who did not smoke. For legal options and litigation information consult an attorney.
